Online booking regulations on website

1. These regulations define the rules for placing an order and using the mobicars.pl service.
2. The administrator of the MobiCars.pl website is MobiCars Sp. z o.o. Sp. k., based in Warsaw at ul. Górczewska 53, 01-401 Warsaw, NIP: 5272887600, Regon: 382886269, KRS: 0000778001, email address: kontakt@mobicars.pl, hereinafter referred to as MobiCars or the Rental Company.
3. The reservation of a Vehicle through the website is made after:
  
  1) filling out the reservation form available on the website www.mobicars.pl,
  2) acceptance of these Regulations and the Standard Terms and Conditions by the ordering person,
  3) acceptance of the order by the Rental Company. Before acceptance, the Rental Company may require additional information from the Client, e.g., personal data, photocopy of an identity document, driver's license, payment of a reservation fee or the total reservation fee, payment of a security deposit,
  4) confirmation of the reservation by the Ordering Party.
4. MobiCars will inform by email or phone, to the address or phone number provided in the form, about the acceptance or lack of acceptance of the order within 24 hours of its receipt.
5. If after the Rental Company's acceptance of the order, the Client confirms it only after 24 hours, and by that time the vehicles from the selected class are no longer available, the Rental Company will promptly offer a vehicle from another class or inform about the inability to fulfill the order. In such cases, the total amount paid by the Client will be promptly refunded.
6. If circumstances arise after the reservation is accepted that make it impossible to rent a car of the agreed class, the Rental Company will provide a higher class car, applying the same daily rate applicable to the class of the vehicle the reservation was for. This does not require separate notification to the Client. However, the Client has the right to withdraw from the contract if they do not agree to the change of vehicle class. In such a case, the Rental Company will refund the total amount paid by the Tenant.
7. If it is not possible to provide the Tenant with a vehicle of the selected or higher class, MobiCars will promptly inform the ordering party of this fact. In such cases, the Rental Company will withdraw from the Contract and refund the Tenant all payments made unless the Parties agree on renting a vehicle of another class.
8. Payments for the rental can be made by the Ordering Party after the Rental Company has accepted the placed order:
  
  a) online transfer via the tPay.pl transaction portal,
  b) payment or credit card via the tPay.pl transaction portal,
  c) bank transfer to the mBank account: 32 1140 2004 0000 3502 7864 9017 with the consent of the Rental Company and providing precise instructions and payment title,
  d) payment or credit card at the time of vehicle collection,
  e) with the consent of the Rental Company, in cash in PLN or another currency, at the exchange rate agreed with MobiCars.
9. Both the Rental Company and the Client may withdraw from the Reservation Agreement within 14 days of its conclusion by sending a statement electronically without giving reasons. Withdrawal from the Reservation Agreement is not possible after the Vehicle Rental Agreement is concluded (usually at the time the vehicle is handed over to the Tenant).
10. Until the vehicle is picked up, the Client can cancel the Vehicle Reservation for a refund of:
  
  a) the total fees paid when placing the order, provided that the cancellation statement is submitted at least 72 hours before the date agreed by the Parties for the ordered vehicle's delivery.
  b) the fees paid when placing the order, minus the Reservation Fee equivalent to 10% of the reservation value, not less than 100 PLN, if the cancellation statement is submitted less than 72 hours before the date agreed by the Parties for the ordered vehicle's delivery. If no fees have been paid before the ordered vehicle's delivery date and the reservation is canceled less than 72 hours before the agreed delivery date, the Ordering Party will be charged 10% of the reservation value, not less than 100 PLN.
11. If the Vehicle is not picked up within 1 hour of the agreed time and the Rental Company is not informed about the cancellation of the Reservation or the postponement of the vehicle collection time, the Reservation is considered unfulfilled. In such cases, the Ordering Party will be charged 10% of the reservation value, not less than 100 PLN.
12. The Rental Company will refund the amounts paid by the Tenant within 7 business days from the occurrence of circumstances justifying the refund, e.g., after withdrawal from the contract or cancellation of the reservation.
13. The car is delivered to the Client at the time and place indicated by them in the order form or agreed later.
14. The vehicle handover, and thus the conclusion of the Vehicle Rental Agreement, can be made by the ordering party or a person indicated by them during the reservation process and accepted by the Rental Company.
15. The Tenant can only be a person who is at least 21 years old and has held a driving license for at least one year, authorizing them to drive on the territory of the Republic of Poland.
16. Complaints containing identification and contact details along with a description of the service being complained about should be submitted to the email address: kontakt@mobicars.pl. The response to the complaint will be provided electronically to the email address within 14 days of its receipt.
17. MobiCars Sp. z o.o. Sp.k. may transfer personal data for the purposes specified in this document to the following third parties:
  
  a) entities with which MobiCars Sp. z o.o. Sp.k. has concluded a data processing agreement, to carry out the Company's activities. Such entities will be obliged under agreements concluded with MobiCars Sp. z o.o. Sp.k. to apply appropriate security measures, both technical and organizational, to protect personal data and process them only according to the instructions provided by MobiCars Sp. z o.o. Sp.k.
  b) supervisory authorities, authorities, and other third parties; If necessary for the purposes specified above and to fulfill legal obligations, personal data may be transferred to supervisory authorities, courts, and other authorities (e.g., tax and law enforcement authorities), independent external advisors (e.g., auditors), or entities providing services.
18. MobiCars Sp. z o.o. Sp.k. as the Data Controller undertakes to apply appropriate security measures, both technical and organizational, to protect processed personal data. Personal data is stored by MobiCars Sp. z o.o. Sp.k. or by data processing entities only for the time necessary to achieve the purposes for which the data is collected, i.e., for the duration of the consent and for the period required by law (in particular tax law and the statute of limitations) after its withdrawal.
